New Caledonian Labor Law

An employer must inform, warn and protect each of his employees against possible dangers and risks related to their work. This is why the NC Safety Passport is a tool at the service of companies to comply with article LP.261-1 of the New Caledonian Labor Code. In addition, through this information, employees are made aware of their rights and duties with respect to article LP261-10 of the New Caledonian Labor Code.

  • Article Lp. 261-1   (Livre II, Titre VI, Chapitre 1er, Section 1, Sous-section 1)

The employer implement all necessary measures to assure the safety and to protect the physical and mental health of his employees.Such measures include:

1° measures of occupational risk prevent;

2° information and training;

3° creation of an organisation and adequate means..

The employer adapts these measures heed of changes in the context and tend to improve existing situations.

 

  • Article LP.261-10   (Livre II, Titre VI, Chapitre 1er, Section 1, Sous-section 3)

Each worker has to take care of his health and safety, as well as those of other people affected by his acts of negligence at work, especially by respecting the instruction given by the employer and, if existing, the rules of procedure.

To achieve these aims, the workers must, according to their training and their employer's instructions:

1

1° use machines, devices, tools, dangerous substances, transport equipment and other means correctly;

2° correctly use the provided personal protective equipment, and return it after use to its proper place;

3° do not switch off, change or remove safety devices arbitrary, especially those from machines, tools, installations and buildings, and use such safety devices correctly;

4° immediately report any defects of protection systems.
